The Publications Division (PD), one of the leading publishing houses in the Country and the largest in the public sector, functions under the Ministry of Information and Broadcasting. It attempts to promote National Integration by disseminating information and creating awareness about the various activities, regions, people and the myriad cultures & beliefs of this Nation.

The Division publishes and sells books at affordable prices through its outlets in important cities and also through agents. It also participates in exhibitions and books fairs to promote the sale of books and journals. Till date, 7500 titles have been published, of which 1500 are live today. Besides books, the Publication Division has also brought out 21 Journals in various issues of national and social significance.

Officials at CB told Rising Kashmir that they received a written complaint duly endorsed by Chief Judicial Magistrate, Jammu under section 156 (3) Cr PC in which complainants Anil Kant Gupta son of late K K Gupta and Rohit Gupta son of K R Gupta had alleged that Renu Shan wife of Rakesh Shan presently residing at 126- Upper Gujjar Nagar and working as Medical Officer (ISM) was appointed as Medical Officer (Ayurvedic) under RBA category, certificate of which was issued under reference No 15/BC by Tehsildar Kishtwar. However on the basis of information received by the complainants through Right to Information Act, it was found that RBA certificate issued under reference No 15/BC dated May 25, 2004 was actually issued to Sunaina Devi wife of Ashwani Kumar and not to Renu Shan. Therefore, Renu Shan had intentionally used the fake and fabricated RBA category certificate in order to secure her selection and appointment. On receipt of this complaint, officials said, an enquiry was initiated in CB and during the course of enquiry, it was found that Renu Shan was married to Rakesh Shan, a resident of Kukarwas, Kishtwar. She obtained her RBA category certificate in the year 2004, which was a fake certificate prepared and issued by Naib Tehsildar Balgran, who certified that the beneficiary was continuously residing in the backward area for the last 15 years, when actually Renu Shan had married in the year 2003 and was therefore not eligible for the issuance of the RBA certificate. It was also found that in the year 2006 Renu Shan had submitted another application supported by an affidavit, for issuance of RBA certificate, stating therein that she had not applied earlier for the issuance of RBA certificate neither any RBA certificate was previously issued to her, which in fact was contrary to records as RBA certificate was issued to her in the year 2004. It was further found that officers of the Revenue Department in Kishtwar by abusing their official position and in order to confer undue benefit upon Renu Shan had issued two RBA certificates in the year 2004 and 2006, in gross violation of SRO 126 of 1994 and SRO 294 of 2005, without fulfilling the required formalities governing the issuance of such certificates. The CB has registered criminal case under FIR number No 12 of 2013 under section 420, 465, 466, 468, 471, 120-B RPC r/w Section 5(2) PC Act Svt. 2006 against Dr Renu Shan, then Tehsildar Kishtwar M A Lone, and other officers/officials of the Revenue Department, Kishtwar for their involvement in the offences of cheating, fraud, forgery and criminal conspiracy.

In 2003, a complaint was filed against him for alleged corruption before the CBI director (http://timesofindia.indiatimes.com/topic/CBI-director)which was not pursued by the officials concerned. The case came up before the Central Information Commission (http://timesofindia.indiatimes.com/topic/Central-Information-Commission) in 2009 after complainant Rajendra Singh failed to get file notings and material from the agency on the basis of which inquiry into his complaint against Dutt, the then DSP in Dhanbad, was closed. CBI, in response to Singh's RTI application, had claimed that substantial information was provided to him except the secret notings contained in the file. "The officers concerned have recorded these notings in good faith for the superior officer and with confidence and trust that these would never be disclosed to anyone," the agency had said. It had said the notings, based on which the CBI director arrived at a conclusion, were not disclosed as these were in the form of fiduciary relationship. Rejecting the agency's contention, the then chief information commissioner Wajahat Habibullah had directed it to make public reasons and file notings on the basis of which the inquiry against Dutt was closed. "There is nothing in this noting that could possibly be construed as invading the privacy of the officers submitting the note, since there are no personal details disclosed by either officer, nor is the noting such as would compromise the confidentiality of any of the parties, since it is known who the officers concerned were," Habibullah had said after perusing the file. CBI has arrested Dutt, who was one of the investigators in the coal scam case, on May 17 for allegedly receiving bribe from a businessman.

While there have been several allegations of the police’s high-handedness when it comes to a complainant or an accused asking for an FIR’s copy, Gaikwad’s order came after a right to information applicant, Shrikant Joglekar, demanded that he be given a copy of an FIR of a complaint pertaining to some property registration filed against him in October last year. Joglekar alleged that officials of the Andheri police station had refused to hand over a copy to him, claiming that doing so would hamper their investigation process. “A false FIR was filed against me. But to get it quashed, I needed to get a copy of it to argue my case in court,” said the 63-year-old consulting engineer. He claimed that several “fraudulent” FIRs have not been quashed just because their copies were not handed over to the accused. When the RTI application was taken up at the SIC, the police said Joglekar was told during his questioning that he wouldn’t be given a copy of the FIR against him on the grounds that it would affect the probe. To strengthen his case, the applicant cited a Delhi high court order, passed in 2010, which directed the police to upload copies of all FIRs on their website unless senior officers give enough reason against doing so. Gaikwad directed the office of the director general of police and all senior officials to ensure that the order is communicated to all state police stations and implemented by June 10. The Odisha police have a similar system in place. Sanjeev Dayal, Maharashtra director general of police, refused to comment, saying he was yet to see the order.

Sounds outrageous, isn’t it? Now, what if the high tea is for 200 people and the lunch for 150. The bill will be a whopping `2.40 lakh and `5.25 lakh respectively; total `7.65 lakh. And that is exactly how much the Union ministry of tourism had paid for its guests for just for a day during the recently held United Nations World Tourism Organisation (UNWTO) conference on “Sustainable Tourism Development”. The expenditure for the three-day conference was a staggering `2.14 crore. This was revealed by an RTI enquiry filed by one Sai Prasad from the city. The expenditure on the meet, held from April 12-14 at the Park Hyatt and Taj Falaknuma hotels, has drawn criticism from social activists. It includes `1.25 lakh for three ‘recce visits’ to Hyderabad by a couple of persons. The cost of “Branding at Hyderabad for UNWTO Meeting” raises even more eyebrows. The bill for outdoor branding alone was `25 lakh. Another `10 lakh was spent on ‘artwork, design, printing and mounting of flexis on hoarding’. A sum of `9 lakh was spent on “small 3-4 feet replicas of different monuments for placing at the venue”. Finally, the total cost of branding was `44 lakh. Then come the phone calls, for which `4 lakh was paid! “This is really the height of wasting taxpayers money,” fumed Sai Prasad. The entire expenses management was undertaken by Ashok Events, Indian Tourism Development Corporation (ITDC), which was appointed as the event manager on the basis of the MoU signed between the ministry of tourism and ITDC, the RTI said. “There are so many costs which seem frivolous and seem like inflated. Where is the need to spend `1,200 on high tea?” questions Prasad. As per the RTI, a mind-boggling `27.7 lakh was spent for one night–`5 lakh for dinner, `10 lakh for meals and transportation for artistes and `6 lakh for ambiance at Golconda Fort etc. “They say they have no money all the time. How are they able to spend so much then?” asks Prasad.

Chief Information Commissioner Bhim Sen said that so far more than 80 per cent of applications field under RTI are related to individual issues and effort are on to change this trend and make the use of RTI more public oriented. "The idea is to motivate the rural people to file RTIs to seek information about the allocation and expenditure of funds for development, developmental schemes for their areas and their implementation and use/misuse/abuse of public funds," he said. Every government department or public sector organisation would also have a nodal agency to ensure time bound delivery of information for "corruption free" governance, the CIC said. The CIC has tied-up with Himachal Institute of Public administration (HIPA) for organising the campaign and some workshops have already been organised in main cities and interior areas of Shimla, Sirmaur and Kangra districts. HIPA uses traditional modes of communications including folk songs, theatre, streets plays in local dialectics for popularising RTI, he said. Sen said that instances of threat and social boycott of RTI activists have come to light and the Commission has taken action against the officials denying information or using extra-official means to browbeat the citizens for seeking information. The CIC informed that nearly Rs 5.61 lakh have been recovered as penalty imposed on the Public Information Officer (PIOs) for denying or delaying the information to citizens. The CIC has also developed a software named as SIC using information technology as a medium to track cases of denial of information and ensure that citizens get easy access to public information.

Moreover, another doctor conducted drug trials of different companies and 10 of his cancer patients (http://timesofindia.indiatimes.com/topic/cancer-patients) died during the trials. An RTI filed by a government-run Indore hospital Dr Anand Rai exposed deaths leading to drug trials in entire country. Answering to the RTI, office ofdrug controller (http://timesofindia.indiatimes.com/topic/drug-controller) general, ministry of family health and welfare, gave a list of deaths to the appellant that happened during clinical trials. Exposing that 40 patients died from 2008 to 2011 during clinical trials in Rajasthan, drug controller office report shows that only eight hospitals were majorly involved in clinical trials, where deaths were reported and two of them were government hospitals. The report shows that 27 deaths during clinical trials were reported in private hospitals, which shows that the private hospitals took a lot of interest in clinical trials. Besides, 13 deaths during drug trails were reported in two government hospital of the state. Most of the patients died during clinical trials, who were suffering from cancer, heart ailments and gastro related problems. At least 21 patients suffering from cancer died during clinical trials from 2008 to 2011 in the state, while 12 heart patients and five gastro patients died during clinical trials in the same period. Rajasthan has emerged as one of the hubs for clinical trials in country and it has brought along its side effect too. At least 40 people died in the state from 2008 to 2011 during clinical trials especially to check the efficacy of drugs for cancer, heart and gastro treatment. The state government (http://timesofindia.indiatimes.com/topic/state-government) too accepted in the counter affidavit filed before the Supreme Court (http://timesofindia.indiatimes.com/topic/Supreme-Court) in relation to a PIL, that there were 326 clinical trials conducted in the state. But, the figures could be much more as information from various principal investigators are still to come. I Rajasthan there are at least 139 principal investigators, who are conduction clinical trials. In the affidavit, the state government mentioned that at least 139 principal investigators are present in Rajasthan as posted on the website of the Clinical Trials Registry- India (CTRI). But, the state government, expressing concern over deaths during clinical trials, mentioned in the affidavit that the state government must also be involved with regard to registration of sites, hospitals, institutes for conduct of trials, the nature of trials which are going to be conducted, the criteria for selection of patients who would be administered during trials. The state government mentioned in the affidavit that from 2005 to 2012, at least 95 persons died. Moreover, in four death cases, the decision to pay compensation has been taken. But payments in two cases have been made and compensation proceedings are in process for two cases.
  • RTI Act does not draw a distinction between demand for information in public interest and private interest._*The Full Bench Orders of the CIC are as below :*_ 56. The respondent’s counsel has tenaciously argued that the appellant’s request for information is not in public interest and that he is seeking this information for extraneous considerations. The question is whether information is disclosable under the RTI Act only in public interest and not otherwise. Suffice to say that RTI Act does not draw a distinction between demand for information in public interest and private interest. The Act provides for disclosure of information to the citizens of India subject to the provisions of section 8, 9, 10 & 11 of the RTI Act. In other words, appellant is not required to establish any larger public interest in his search for all classes of information. He is required to establish public interest only in particular clauses of section 8(1) of the RTI Act. In view of the above, we hold that appellant need not establish public interest while seeking information for all classes of information.
