According to reports, the petroleum ministry (http://timesofindia.indiatimes.com/topic/petroleum-ministry) had written to the law ministry to replace Chandiok from a crucial case against Essar Steel claiming that he took a stand against its instructions. The reply was in response to an RTI application filed by Subhash Agrawal seeking a copy of file notings and letter written by the petroleum ministry to the law ministry seeking Chandiok's replacement. The transparency panel allowed disclosure of communication and file notings. The commission rejected the contention of the petroleum ministry that the letter was "confidential" and related to a "sensitive issue", so it should not be disclosed. The law ministry in a letter dated June 12 said the letter was untraceable. "It is a well settled law that the public authority can claim exemption from disclosure only as per the section 8 (1) of the RTI Act. In the present appeal before the commission, the respondent has not claimed any exemption as per the RTI Act nor been able to explain how the information if revealed would attract any of the exemption as per the Act," information commissioner Information Commissioner said. Essar Steel had approached the Delhi High Court challenging the petroleum ministry's move to reduce the supply of natural gas from the Reliance KG-D6 fields to non-core sectors. It had maintained that if gas supply was reduced, the company would face hardship. While the court had passed orders on June 3, 2011, the ASG reportedly intimated it to the petroleum ministry on July 1.

But these grants have not been assessed in the case of some universities for almost 10 years now. This was revealed by an RTI reply received by The Indian Express. The University of Pune got salary grants, worth Rs 2,0231.97 lakhs from 2004-5 till 2011-12. But assessments were done only till 2006-07, reveals the RTI report. University of Mumbai has taken a grant of Rs 1,438.43 from 2004-05 till 2011-12. But assessment was carried out only till 2002-03. But none can beat SNDT, Women's University, Mumbai, which has the highest number of pending assessments. The university received grants worth Rs 11,660.90 from 2004-05 till 2012 but the assessments were not carried out since 1995-96. The grants that are given to universities are to be released on a yearly basis, depending on grants that the university got in the previous year. "The adjustment are to be carried out during current year with respect to excess/short release for previous year," says the RTI reply. But nothing of this sort was followed by the directorate. A total of Rs 1,01,735.50 lakh were released during past eight years to 11 universities, even though none of the universities have up-to-date assessment of grants given to them. "This shows the sorry state of the education department in the state. Even though the previous year's grants have not been assessed, future grants have already been released. This puts both universities and higher education officials in a spot. When there is no record to show how these grants were used by the universities, how can the higher education department send yearly reports to the government on utilisation of funds. This shows the total failure of the system," said activist Vihar Durve. "It is true that assessment of grants have not been done for long. But we do not think there is any wrongdoing on the part of the Universities. We have asked the joint directors in 10 divisions to assess the grants in their respective universities. We are sure that the assessment work will be completed soon," said an official from the Higher Education Department.

But it is different with Chief Information Commissioner Satyananda Mishra, a man who is fighting the system from within. Last week, the 1973-batch Indian Administrative Service (IAS) officer of the Madhya Pradesh cadre rocked the establishment when a CIC bench chaired by him passed an order to bring all major political parties under the Right to Information (RTI) Act – a decision that could have major ramifications for the functioning of Indian politics. The decision ended up drawing the ire of leaders from across the political spectrum, but then Mishra has never been known to shy away from stepping on a few toes. *'Unafraid'* "He has always been very bold. He is never afraid to make a decision," said Subhash Chandra Agrawal, a dedicated RTI activist. "I would call him the ideal CIC, both in terms of administrative capacity and quasi-judicial skill." A graduate of Utkal University, with an M Phil in Public Administration from Panjab University and an MSc in Policy Planning from the London School of Economics, Mishra's decisions have always been aimed at making the system more accountable – be it directing the RBI to come clear on its policy on 'suspense accounts' in 2009, as election commissioner, to the one about political parties. But while he is a celebrated personality today, back in 2010, his election as CIC was widely opposed by activists on the ground that a bureaucrat who had spent much of his career submitting to the demands of the government could not be trusted with a role that requires a substantial amount of independence. Agrawal, however, says the stand was misconceived. "It is true that while they are in the bureaucracy, they have to be in their limits," he said. "But, as we have seen in Satyananda Mishra's case, his long career in the government has given him the chance to observe loopholes and see through the arguments of some of the Central Public Information Officers." *No conflict* In fact, Mishra had encountered, and overcome, the "conflict- of-interest" during his tenure as information commissioner, when he was assigned an RTI application seeking file noting. The Department of Personnel and Training (DoPT), where he had served as secretary, was vehemently opposed to the demand. But Mishra ruled that file noting does come under the RTI Act, and even called for ministries and departments to put them online. It was only a matter of time before the DoPT gave in. In fact, making information freely available through the Internet has been his pet cause. While ruling on several RTIs, for example those pertaining to trips taken by public office-holders, Mishra has not only called for information to be handed out to petitioners, but also for it to be uploaded online with regular updates. *Revolutionary* Additionally, activists say, the CIC's functioning has improved under his administration. Where the registry might earlier have taken weeks to accept a petition and assign it a date, the CIC now does it within 72 hours. He has also moved to make the CIC a paperless institution, introducing the use of a dictaphone to keep things transparent.

  • RTI Information: Problem with RTI-Airports Authority of India RecruitementHi all, I have filed an RTI with CIC(RC/UG/13/9975j0sv) regarding the upholding of recruitement process of Advt 02/2012 by Airports Authority of India.They have declared the final results on jan 25,2013. and on may 10th,a notice appeared in website that due to adminstrative reasons,the process is kept on hold. I have filed an RTI through CIC website online,signed the PDF copy and sent to the CIC through speed post.I did not pay any fee for that.The status is showing that *signed copy awaited*,where the spped post tracker is showing that it is delivered. Pls tell how to find the status of the application. Also i have few queries regarding my complaint.. 1)I have asked for adminstrative reasons due to which the process is kept on hold 2)The reasons why it is taking more than 1 year to complete the recruitement process. Can I ask the above information from Airports Authority of India?? Also,there is some reliable information that the recruitement process is going to be cancelled.
