That's the stand of a state government department on the Right to Information Act. The department has said that it will not furnish information under the RTI Act (http://timesofindia.indiatimes.com/topic/RTI-Act) if the application contains questions. "Under the RTI Act, 2005, your queries submitted to the public information officer cannot be in question form… Under Section 2(f), which defines 'information' , questions have not been defined as information. Hence we cannot furnish the information you had sought." This was the written response of the public information officer (PIO) of the legal metrology department to four RTI applications filed by TOI. The legal metrology department, part of the labour department, acts on complaints regarding weights and measures and maximum retail price. Consumers often complain of overcharging and under-measurement by traders as well as a lack of response to complaints. TOI filed RTI applications seeking information on the number of inspections conducted by the department and the number of shopkeepers penalized for offences in the last five years. The PIO rejected the application saying questions were not allowed. RTI activists said the response was a classic example of PIOs denying information without valid reasons. "If we cannot ask questions, why do we need to file an application under the RTI Act? The state information commission should impose a fine or take action against such PIOs," said RTI activist M Thuyamurthy. Former bureaucrat M G Devasahayam said the RTI Act had failed in the state. "There is no format for seeking information under the RTI Act. PIOs invent excuses to deny information. They should be show more sincerity towards implementing the legislation. The SIC should take stringent action against such officials," he said. State labour commissioner Dr B Chandramohan said he was unaware of information being denied to RTI applicants. "I will check with the officials concerned," he said. According to Section 2(f) of the RTI Act, information means any material in any form, including records, documents, memos, e-mails , press releases, circulars, contracts, samples, models, data held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law in force. HOW TO FILE AN RTI APPLICATION (http://timesofindia.indiatimes.com/topic/RTI-APPLICATION) An RTI application can be made on a sheet of plain paper and can have any number of questions It should be addressed to the public information officer of the department or organisation concerned 10 should be paid as application fee by cash or through postal order, court fee stamp or demand draft Questions should be direct and leave no room for the information officer to give vague replies Information officer has to reply within 30 days of receipt of the application, failing which he is liable to a fine of 250 per day Appeal can be filed with the head of the department in which the application was filed, if the information officer fails to reply within the deadline Second appeal can be filed before the central or state information commission if applicant is not satisfied with the replies.
  • RTI Question: land ownershipour ancestor own a piece of land in which 40 years back some part of it was given to a friend just for building a house to live(no ownership)there was no written agreement between them. but later he build 3 more rooms on it and now claims the surrounding land too and does not allow me to build our own house in surrounding land. i have the papers of land ownership and he has tax receipts,electric bills etc.but nagar sevak says that my own house is illegal and will be demolished if the friend lodge any complain. what should i do? i have no place left to build my own house please help…….

While disposing of an appeal, Annapurna Dixit, the Information Commissioner (IC), said, “…the public authority is obligated under section 4(1)(b) the Right to Information (RTI) Act to disclose information related to the service of its employees. The Commission is not convinced by Allan D'Costa’s (the TC) argument that such disclosure will endanger his physical safety as all this information is anyway expected to be placed in the public domain.” Mumbai-based RTI activist Chetan Kothari had filed an RTI seeking information against six points with regard to information on action taken on his complaint against TCs Allan D'Costa and SR Shukla, including copy of the service book and confidential report of Allan D'Costa. While the PIO furnished the information on all six queries asked by Kothari, he denied copy of service book of D'Costa. Even, the First Appellate Authority (FAA) ordered the same. Kothari then filed his second appeal before the Commission. During the hearing, the PIO submitted that when he sought submission under Section 11(1) of the RTI Act, D'Costa objected to the sharing of his service book stating that the disclosure of his service details would endanger his physical safety and that of his family members. Ms Dixit, the IC, however was not convinced by this argument. She then directed the PIO to supply a copy of the service record of Allan D'Costa to Kothari within four weeks after invoking Section 10(1) of the RTI Act to sever all those portions that are exempt from disclosure u/s 8(1)(j) of the Act as personal information.   • RTI Improvement: Maharashtra: BMC cell to hasten RTI processReported by Hindustantimes.com on May 24, 2013 BMC cell to hasten RTI process – Hindustan Times (http://www.hindustantimes.com/India-news/Mumbai/BMC-cell-to-hasten-RTI-process/Article1-1065150.aspx) In a bid to speed up the entire information-providing procedure involved in the Right To Information (RTI) act, the BMC has set up a Technical Advisory Committee that includes administrative staff and experienced RTI activists. The nine-member recommendatory committee met for the first time on Thursday and will meet once a month. After closely studying the nature of RTI applications received by the corporation over the past year, the committee has found that the maximum number of applications was received by the Building Proposals Department and Buildings and Factories Department. “Almost 15% of the total number of RTI applications received across Maharashtra state came to the BMC last year. Over the past few years alone, there has been a perceptible rise in the number RTI applications,” said Shailesh Gandhi, former chief information commissioner and TAC chairman. “Thus, the committee will try and understand the nature of information that citizens seek, and if necessary, make it available on a suo moto basis.” The committee will also help the BMC to put up important information on the website. RTI activist Bhaskar Prabhu from Mahiti Adhikar Manch said, “There are times when the concerned civic staff does not provide responses to applications in the right manner. Thus, the TAC will also be training these officials to provide accurate information to the citizens.” Prabhu insisted that this training would be undertaken through interactive sessions, meetings and workshops with the civic staff.

Passing off the judgment, two-member division bench of the Commission headed by Chief Information Commissioner GR Sufi ruled that schools enjoying exemption of income tax which is more than 33% of their total income are public authorities under the Act “because then they are substantially financed and funded by the government.” “Giving exemption of income tax which is more than 33% of the total income is a substantial funding by the Government. Hence, if school falls under the definition of substantially financed by the Government and thus a public authority and school should, therefore, follow the mandate given in the State RTI Act, 2009 and report compliance to the Commission with the various provisions of the State RTI Act, 2009 and within 30 days from the receipt of this order,” the Commission held. The Commission also held that school is a body controlled by the government and information can be sought from them from the body regulating them, in case they pay income tax. “If we presume school is not a public authority, yet it is under a statutory obligation to furnish the information desired by the Directorate of School Education, pertaining to its functioning and activities from time to time,” the ruling reads. According to the ruling, the Commission also held that Section 2(f)(iv) of the Act “recognizes that the non-state actors shall also have statutory obligation to disclose the information which would be useful and necessary for the people they serve.” Today’s judgment comes as another major boost for ensuring transparency in private schools of the State. Pertinently, the State Government had already set up a committee headed by Justice (retd) Bilal Nazki to regulate fee in private schools. The Commission today also said “the issues relating to management and regulation of schools responsible for promotion of education are so important for the development of the nation that it cannot be left at the whims, fancies, idiosyncrasies and caprices of private institutions whether funded or not by the Government.” “Today, the State of Jammu and Kashmir is facing a difficult task of ensuring social justice and equality to all the sections of society,” it reads.
  • illegal and unauthorised constructionDear Sir, This is to inform you that one builder Mr. Ashwani Kohli constructing 8 floors on a plot size 220 Sq. Yd. The address of location is BES – 40, Hari Nagar, Near Ram Garhia Gurudwara, New Delhi – 110064. We so many times requested him to stop multistory construction. The Plot is having 10 foot of narrow road at its both side. There is lot of parking problem. He already constructed packing at ground floor which is good but it should at wider road where cars can easily be parked by passing through narrow road and/or Gali. Also there is dust, muddy, water lodging everywhere near the plot as well as our houses due to which a normal person cant breath there. We also went to local police and MCD office but they had given so many excuses which clearly shows that they may have taken some undue advantages from builder that is why we were regretted. Sir please advice us where we go to get peaceful life. We already marked a complaint to you but no action was taken till date. Its our humble request to you people please so needful and stop this construction work immediately to save the life of surrounding residents. Regards Simple Mann
  • RTI Question: Transfer rulei am a, auditor at Indian Audit and Account Department, , have joined on 07/02/2012 at Kolkata and my husband who is also serving govt of india as an Inspector , Department of Post, presently posted at orissa circle have joined on 19/06/2012. is there any probability of transfer on spousal ground by which my husband can be transferred to WB circle ..? If so then what is the procedure and what are the mandatory field that is required ..?
  • HUDA karnak have sealed the door of the Hospital opened on main roads.In karnal in HUDA sectors there were more than 20-30 hospitals who had opned the gates of their hospitals on the main roads of the sectors. It took one year … and HUDA have now finaly sealed many such doors and other have themself constructed wall and closed the doors.because of these door there was a great disturbance particularly of traffice ……….. now the people are happy. another RTI victory.
  • karnal club a registred societ headed by Deputy commissioner as president ….club say …not covered under RTIIn karnal haryana thehre is an old club known as Karnal club having 50% govt official members and Deputy Commissioner being ex officio president of the club ……….club buildinen n thg is being leased by Jila Paresad on nominal Rs 10000/- PM……..even then club says that it is not covered under RTI.
  • RTI to get Status of occupancy certificate for a building in Thane-wMy flat building is 100% completed by Oct 2013, but its occupancy certificate has not yet come. Its almost 6 months completed when builder applied for OC, even TMC inspection also done long back. Could you please me with procedure to find status of occupancy certificate & when TMC will issue OC to our building.
